chief justice roberts for preparing me john june 28 for the disappointment i would feel on november 6. i approached the court that day with a lot of anticipation. i had read all the breefs in that case and sat through four days of oral argument in that case. i had watched every movement, every eye twitch, every response to every question, every facial expression and i had listened closely to all the questions that they had asked. i thought i knew what the answer was going to be. a lot of it was wishful thinking. but i approached the courtroom that day with a lot of anticipation and a lot of hopefulness. as i took my seat in the bar session of the supreme court that day. i look to my right and slightly behind me to the section of the courtroom where the law clerks sit. i remembered just a few years earlier when i served aze a law clerk and sat in those chairs and i remembered how much fun it was to watch the justices announce a decision that they had been working on. we knew the result before the rest of the audience did. it was fun to watch their reactions. then i looked to my right and

director david petraeus. general john allen is the top u.s. commander in afghanistan. officials are investigating him for, quote, inappropriate communication with jill kel kelley. she's the woman that got the petraeus investigation started. the pentagon is looking at more than 20,000 pages of documents and e-mails between kelley and general allen. 20,000. officials tell the ap that some of the material was, quote, flirtatious. general allen denies having an affair with kelley, who we know was also friends with general petraeus. joining me now is michael isikoff, national investigative correspondent for nbc news. he's been breaking some of the big details on this case over the last few days. michael, first, thanks for being here tonight. >> thank you. good to be with you. >> now, let me ask, general allen is now under investigation for his relationship with jill kelley. what can you tell us about the relationship and what can you tell us about miss kelley. >> we should say we don't know for sure. as you pointed out, the e-mails, these voluminous -- apparently voluminous e-mails d

president obama won reelection . he holds the edge in the discussion right now . speaker of the house john boehner immediately saying he generally supportive of trying to close the loop holes. do you see that as raising taxes? >> what boehner said and in the republican position since republican we should reduce rates have economic growth many of which are put in by obama for the solyndra green-type energy programs. let's bring the rates down. boehner was clear he wanted increase revenues it is not a tax increase to put more americans at work. if our recovery was growing the rate reagans did more americans would be at work. in terms of raising revenue which boehner grew about. if you grew the economy at reagan levels instead of two percent and obama and french levels, just growing faster and do that for a decade, the federal government gets trillions in taxes. we could undo the damage by having higher growth. >> gretchen: that's the difference in ideology. raise it to 3#.9 percent x. replace the alternative minimum tax with the buffet and raise the state tax and long-term capitol gains from

house speaker john boehner told politico the day before the election about whether president obama has a mandate on this issue. listen, our majority is going to get re-elected, we'll have as much of a mandate as he will to not raise taxes. what do you say to mr. boehner and his supposed mandate right now? >> well, i think that he said that the election would be a mandate, it was, and he lost. and i think that the important point about the crystal comment is that there's now a wedge in the republican party that the president needs to exploit. there's a wedge between the realist wing and the kind of fa fantasy, childish wing. the realist wing understands the president has a mandate. democrats won the presidency and the senate. we won a majority -- we won the popular vote if you add up the house races as well. look, i think it's in both parties' interest to avoid the fiscal cliff. neither of them want it for a whole host of reasons, including it will be damaging to the economy. we learned recently that president obama in august of 2011 was kind of ready to do a nixon goes to china moment
